Social media also continues to receive enormous attention from the government as well. The National Labor Relations Board has taken an aggressive position, finding that many employers have violated the Section 7 rights of their employees by implementing “overly broad” or “ambiguous” social media policies that could potentially restrict the employees’ right to engage in “protected concerted activity’- which applies whether or not an employee belongs to a union. Further, one item on the EEOC’s 2014 stated agenda is to “eliminat[e] barriers in recruitment and hiring.” And based on what the EEOC did last year, they mean it.
